Terms of service

These terms apply when you visit snackiva.net or buy from Snackiva LLC ("Snackiva", "we", "us"), Lutz, Florida. By using the site or placing an order, you agree to them. Please read them together with our privacy policy, shipping policy and FAQs.

1. Using our site

You must be at least 18, or the age of majority where you live, to place an order. You agree to give us accurate information and to use the site only for lawful purposes. You may not misuse the site, for example by trying to break its security, sending spam, or interfering with other shoppers.

2. Our cookies (the food kind)

Our cookies are handmade in small batches. Made in a cottage food operation that is not subject to Florida's food safety regulations. Each product page and box lists the ingredients and allergens. All our cookies contain milk and almonds, and some also contain other tree nuts such as pistachios; please check each product before ordering if you have a food allergy. Product photos show our cookies as closely as we can; real cookies vary a little in size, shape and color.

3. Prices and availability

Prices are shown in US dollars. We may change prices, products and availability at any time, but a change won't affect an order we have already confirmed. If we make a pricing or listing mistake, we may cancel the affected order and refund you in full.

4. Orders

Orders start at $36 (before shipping). Your order is confirmed when you receive our confirmation email. We may refuse or cancel an order, for example if an item is unavailable, we cannot deliver to your address, or we suspect fraud; if we do, we refund any payment in full.

5. Payment

Payment is taken at checkout through our checkout and payment providers. We do not see or store your full card number. By placing an order, you confirm that you are allowed to use the payment method you provide.

6. Shipping and pickup

We ship within Florida and offer free pickup in Lutz. Delivery details are in our shipping policy. Responsibility for the order passes to you when it is delivered to your address or picked up.

7. Returns and refunds

Because our cookies are food, we can't take returns. If something is wrong with your order, we'll make it right as described in our FAQs.

8. Discounts and gift cards

Discount codes and gift cards have the terms shown with them. Unless they say otherwise, codes can't be combined, have no cash value, and may be withdrawn at any time.

All gift cards are final sale: no returns or refunds, and they can't be exchanged for cash, except where required by law. Gift cards don't expire.

9. Accounts

If you create an account, keep your login details safe; you are responsible for activity on your account. Tell us right away if you think someone else has used it.

10. Emails and newsletter

We send order emails as part of your purchase. Our newsletter is optional, and you can unsubscribe at any time using the link in every newsletter.

11. Your messages and feedback

If you send us messages, ideas or feedback, you agree we may use them to improve our products and service, without any obligation to you. Please don't send anything unlawful, offensive or confidential.

12. Our content

The Snackiva name, logo, packaging, photos and text on this site belong to us or our licensors. You may not copy or use them without our written permission.

13. Third-party links and services

Our site may link to other websites or rely on third-party services (such as checkout and payment). We are not responsible for their content or practices.

14. Disclaimer

We work hard to keep the site accurate and available, but we provide it "as is" and can't promise it will always be error-free or uninterrupted. To the extent the law allows, we disclaim all warranties not stated in these terms.

15. Limitation of liability

To the extent the law allows, Snackiva is not liable for indirect, incidental or consequential damages, and our total liability for any claim about an order is limited to the amount you paid for that order. Nothing in these terms limits liability that cannot be limited by law.

16. Indemnification

You agree to cover any claims, losses or costs (including reasonable legal fees) that arise because you broke these terms or misused the site.

17. Governing law

These terms are governed by the laws of the State of Florida and applicable US federal law. Any dispute will be handled in the state or federal courts located in Florida.

18. Severability and entire agreement

If any part of these terms is found unenforceable, the rest still applies. These terms, together with the policies linked above, are the entire agreement between you and us about using the site and buying from us.

19. Changes to these terms

We may update these terms from time to time. The date at the top shows when they last changed. The terms in force when you place an order apply to that order.
